State Regulatory Requirements Incorporated by Reference
This webpage sets forth state-specific regulatory requirements, contractual provisions, disclosures, and operational obligations applicable to pharmacy benefit management services provided by US-Rx Care. As provided in the applicable Master Services Agreement (“MSA”), these state-specific requirements are incorporated into and made part of the MSA by reference and shall apply to the extent required by the laws and regulations of the applicable jurisdiction. These requirements are intended to supplement the MSA and, where required by applicable law, shall automatically become effective upon publication or update to this webpage without the necessity of a written amendment to the MSA. In the event of any conflict between these state-specific requirements and the MSA, the provision that is required by applicable law shall control solely to the extent necessary to ensure compliance with such law. Clients are encouraged to periodically review this webpage for updates reflecting changes in applicable federal and state laws and regulations governing pharmacy benefit management services.
Updates made to comply with applicable federal or state law shall become effective without further action by either party and shall be binding upon the parties as of the effective date specified on this webpage or, if none is specified, upon publication.
